This email (below) and report
were received yesterday by Glen and myself, as well as City and
Borough staff.
Just a reminder that the next meeting of the Charter Commission
will be June 22 (Thursday) at 6 pm in the Council Chambers.

Good afternoon. Attached, in
electronic format, is this agency's "Final Report to the
Local Boundary Commission on Ketchikan Local Government Consolidation."
Printed copies of the report (in the same quantity as was provided
in the case of the the Preliminary Report) will be mailed
tomorrow.
Please note that June 26 hearing
on the consolidation proposal is scheduled to begin at 3:00 p.m.,
not 2:00 p.m. The Commerce Preliminary Report indicated that
the hearing would begin at 2:00 p.m.; however, a change to the
later time was necessary to accommodate the LBC's schedule. The
3:00 p.m. time is stated in the formal notice of the
hearing. However, I read a recent local statement that the hearing
was still scheduled to begin at 2:00 p.m.

In a letter dated May 4, 2006,
the Chair of the Ketchikan Charter Commission (KCC) asked this
office to carry out, in consultation with staff of the City of
Ketchikan and Ketchikan Gateway Borough, a technical review of
the Charter of the proposed Municipality of Ketchikan. A copy
of that letter was provided to officials of the City of Ketchikan
and the Ketchikan Gateway Borough.
In a letter dated May 17, 2006,
the Ketchikan City Manager expressed support for the KCC request
of May 4. The City Manager urged that "a thorough technical
review of the proposed charter be undertaken and that City and
Borough representative be invited to participate in such a review."
In response to those requests,
this office initiated its review of the draft charter. Participation
by City and Borough officials in the
review of the proposed Charter is strongly encouraged and will
be most welcome. Of course, the involvement of the KCC in the
technical review is essential.
I am attaching three documents
relating to the review conducted to date. The first is a draft
explanation of the technical changes recommended to date by this
office ("05_23_06_Draft_Overview.doc"). The second
attachment is a copy of the proposed Charter showing each proposed
change to date using the "track changes" feature in
MS Word ("05_23_06 Draft Recommended Changes_TRACKED.doc").
The third attachment is the same document as the second attachment,
but with the proposed changes incorporated into the document
("05_23_06 Draft Recommended Changes_INCORPORATED.doc").
Upon request, I will provide
other materials that were used by this office in the review.
Those other materials include a compilation of 107 pages of the
2005 Alaska Statutes that are express limitations on the authority
of a home-rule municipality. Home-rule imitations were found
in AS 14 (Education, Libraries, and Museums), AS 21 (Insurance),
AS 23 (Labor and Workers Compensation), AS 29 (Municipal Government),
AS 30 (Navigation, Harbors, and Shipping), AS 42 (Public Utilities
and
Carriers), AS 43 (Revenue and Taxation), and AS 46 (Water, Air,
Energy, and Environmental Conservation). Other materials used
in the technical review include State of Alaska manuals for drafting
legislation and administrative regulations.
This office must publish its
final report on the Ketchikan Consolidation Petition by June
2. It would be ideal if the technical review of the Charter could
be completed in a manner that would allow the results of that
review to be included in the final report. If the review cannot
be completed in time, a status report on the review will be included
in the LBC Staff final report.

of the attachments and the opportunity to refine the attached
draft materials.

Subject: Remaining steps in the consolidation process
The remaining steps in the
pending consolidation proceedings are summarized below. Details
are provided in our preliminary report
1. The LBC
Staff preliminary report has been completed. The report will be available online
later this afternoon. I will send each of you a link to an ftp
site later this afternoon. Next week, printed copies of the report
will be provided to the Petitioner (KCC), Respondent (City of
Ketchikan), the Ketchikan Gateway Borough, the City of Saxman,
and others. Copies will also be made available for public review
through the Ketchikan Public Library, the office of the Ketchikan
City Clerk, and the Office of the Ketchikan Borough Clerk.
2. The Petitioner, Respondent
(City), the KGB, City of Saxman, and any other interested person
or organization will have until May 18 to review and comment
on preliminary report. To be considered, comments must be received
by LBC Staff no later than 5:00 p.m., on May 18. Comments may
be submitted by mail, fax, e-mail, or other means.
3. After considering comments
on the preliminary report, the LBC Staff final report will be
published no later than June 2.
4. LBC will hold a hearing
on June 26 in the Ketchikan City Council chambers. The hearing
will begin at 2:00 p.m. with presentations and testimony by the
Petitioner and Respondent. After those formalities, the LBC will
recess the hearing until 7:00 p.m., to receive public comment.
5. LBC will render a decision
(LBC has 90 days to do so; however, if LBC members conclude that
they can make an informed decision immediately following the
hearing, it may do so).
6. The LBC must adopt a written
decisional statement setting out the basis for its decision.
7. There is an opportunity
for individuals or organizations to ask the LBC to reconsideration
its decision. Reconsideration may be granted only if
<!--[if !supportLists]-->A. <!--[endif]-->a substantial
procedural error occurred in the original proceeding;
B. <!--[endif]-->the original vote was based on fraud or
misrepresentation;
C. <!--[endif]-->the LBC failed to address a material issue
of fact or a controlling principle of law; or
D. <!--[endif]-->new evidence not available at the time
of the hearing relating to a matter of significant public policy
has become known.

8. If the LBC approves the Petition (with or without amendments
or conditions); the State Division of Elections will be notified.
9. The Director of the Division
of Elections would have 30 days to order an election on the matter.
The election must be held 30 to 90 days after the date of the
election order. Within those time constraints, the date of the
election and the manner in which it will be conducted is determined
at the discretion of the Director of the Division of Elections.
The proposed consolidation, the date(s) of the election(s), and
manner in which the election(s) would be conducted require Federal
Voting Rights Act preclearance. The preclarance request will
be prepared and submitted to the U.S. Justice Department by this
office.
10. The outcome of the consolidation
proposition would be determined by a majority of the areawide
vote (i.e., the total votes cast throughout the proposed consolidated
borough). If voters approve consolidation, the Division of Elections
would be required to conduct a second election for the election
of initial officials of the consolidated borough. If a second
election is required, the date of that second election must be
set within 10 days of the certification of the results of the
first election. The second election must be held 60 to 90 days
after the order of the second election.
